- The Policy contains a range of information regarding the processing of your personal data by SP CENTER SP. Z O. O., including but not limited to:
- defining the types of personal data processed by SP CENTER SP. Z O. O.,
- explaining how and why the Administrator processes your personal data,
- explaining when and why SP CENTER SP. Z O. O. will share personal data with other entities,
- explaining the rights and choices you have regarding your personal data.
- This Policy applies if you are a user of the Site.
- A user is also understood to include a representative who uses the Site on the user’s behalf.
- We process your personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation – “GDPR”).
- The Site contains links to other websites. The Administrator is not responsible for the privacy practices applicable on other sites. At the same time, we encourage you to read the privacy policy and cookie usage rules of any other Administrator after navigating to their website. In the case of the aforementioned documents, we recommend contacting that Administrator directly for further information.
WHO IS THE CONTROLLER OF YOUR PERSONAL DATA?
The controller of your personal data is SP Center sp. z o. o., ul. Biznesowa 5, 35-959 Rzeszów, Dworzysko, entered into the register of entrepreneurs kept by the District Court in Rzeszów, 12th Commercial Division of the National Court Register under KRS number: 0001103347, NIP: 7952581568, REGON: 528507836, hereinafter referred to as SP CENTER SP. DATA COLLECTED FROM USERS
- We collect and process information obtained from you (including your personal data) in connection with your activity on the Site. These data include:
- provided by you in connection with completing and submitting the contact form,
- necessary for the fulfillment of ordered or purchased services, conducting telephone conversations and meetings with our representative, organizing events, training sessions, or activities where the Controller is the organizer, co-organizer, or patron; and data necessary to prepare and present a commercial offer or information about the Site, including data required for direct marketing involving profiling to tailor marketing content—provided you have consented to the processing of personal data for marketing purposes,
- regarding the topics searched and viewed by you,
- regarding your session, your device, as well as your operating system and browser,
- other data contained in cookies.
- Natural persons visiting the Site or using services provided electronically by the Controller are entitled to control their personal data. The Controller limits the collection and use of information about Users to the minimum required to provide services to them electronically, in accordance with Art. 18 of the Act of 18 July 2002 on Providing Services by Electronic Means (consolidated text: Journal of Laws of 2020, item 344).
SHARING PERSONAL DATA WITH THIRD PARTIES
- The Controller does not share personal data with other companies or third parties and does not transfer personal data to third countries, except in situations where the user has given consent for such actions.
- We may share your personal data, to the extent necessary, with:
- entities authorized to receive them under the provisions of law,
- entities processing your personal data on our behalf (e.g., service providers related to the operation of the Site, entities supporting our IT systems or providing us with IT tools, entities providing advisory and consulting services, postal operators, insurers, law firms and debt collectors, banks, accounting firms, payment operators, comment system operators, online chat operators, authorized employees and associates of the Controller who use the data to fulfill the Site’s operational purposes, companies providing marketing services, as well as entities authorized to receive data based on legal provisions).
- Each of the aforementioned entities to whom your personal data has been disclosed becomes a separate and independent personal data controller from the Controller; consequently, they bear all the responsibilities of a controller arising from applicable legal regulations, including the GDPR.
- The data collected in the logs are used solely for the purposes of administering the Site, subject to the reservations provided below. The Controller does not identify the Users of the Site.
- We collect information to analyze potential security breaches; therefore, we simultaneously inform you that we may be required to disclose information regarding a specific Site User’s IP number at the request of authorized state authorities in connection with proceedings conducted by them.
COOKIES AND CHANGING BROWSER SETTINGS
- To a limited extent, we may collect personal data automatically via cookies located on our websites. Cookies are IT data, in particular text files, which are stored on the User’s terminal device and are intended for use with the Site’s web pages. SERVER LOGS
Information about certain User behaviors may be subject to logging at the server layer. This data is used exclusively for the purpose of administering the Site and to enable the use of the Site. It is not associated with specific individuals browsing the Site and is used solely for server administration purposes.
PURPOSES OF STORAGE AND ACCESS TO COOKIES BY THE CONTROLLER
- Among cookies, those that are essential for the operation of the Site can be distinguished and are used for the purpose of:
- maintaining the User’s session,
- saving the state of the User’s session,
- enabling authorization during login,
- monitoring service availability,
- personalizing the Site (for example: remembering the selected font size, choosing a version for the visually impaired or a color scheme),
- improving Site performance – (for example: analyzing how users use the Site by providing information about the areas they visit, the time they spend there, and the problems they encounter, such as error messages. This allows the Controller to improve the operation of the Site),

- improving functionality – (for example: remembering User settings and choices, such as the region they are in, personalized content settings to provide the User with the most personalized content and services possible),
- advertising – providing Users with advertisements matching their interests,
- enabling interaction with social media channels (for example: displaying friends or publishing posts on Facebook and Google+ directly from the site),
- creating statistics, i.e., collecting and analyzing demographic data of persons visiting the Site (for example: information about the region from which the connection was made, the number of visitors) and statistics of User flow between different websites,
- remembering the User’s choice regarding stopping the display of a selected message or displaying it a specified number of times,
- restoring a session,
- remembering the last selected search category,
- displaying the last selected sorting parameter.
FOR WHAT PURPOSE AND ON WHAT BASIS DO WE PROCESS YOUR PERSONAL DATA?
In connection with the implementation of the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“GDPR”), we hereby inform you about the rules for processing your personal data disclosed for the purpose of the agreement for providing content on the Site, as well as about your related rights.
- We process the personal data provided by you for purposes resulting from the legitimate interests pursued by the Controller (Art. 6(1)(f) GDPR), for purposes necessary for the performance of contracts binding us or to take steps at your request prior to entering into a contract (Art. 6(1)(b) GDPR), or when you have given consent to the processing of your personal data for one or more specific purposes (Art. 6(1)(a) GDPR), such as:
- contacting you and handling inquiries sent via the contact form,
- administering and managing the Site,
- providing services ordered through the Site,
- maintaining a newsletter,
- presenting the Site’s offer or information about the Site,
- managing events, training sessions, or classes organized, co-organized, or sponsored by the Controller, in which the User participates.
- On the basis of your consent, we process the personal data you provide in all cases where consent constitutes the legal basis for processing, e.g., if you provide personal data to an extent broader than necessary to establish contact or handle an inquiry sent via the contact form (Art. 6(1)(a) GDPR).
- Actions involving automated decision-making, including profiling, may be taken in relation to you for the purpose of providing services under the concluded agreement and for the purpose of direct marketing conducted by the Controller.
HOW LONG DO WE STORE YOUR PERSONAL DATA?
We will process your personal data for the period of its usefulness, but no longer than is necessary for the purpose for which the data was collected, i.e., the performance of a service, contacting you regarding the handling of an inquiry sent via the contact form, or the administration (management) of the Site.
WHAT ARE YOUR RIGHTS?
By exercising your rights regarding the processing of personal data, you may submit the following requests to us:
- If we process your personal data based on your consent, you may withdraw this consent at any time; however, please remember that the withdrawal of consent does not affect the lawfulness of the processing carried out based on consent before its withdrawal,
- You may request access to your personal data and obtain a copy thereof,
- You may exercise the right to data portability, i.e., request your data from us in a structured, commonly used, and machine-readable format; you may also request that we send this data directly to another controller if we process it by automated means based on your prior consent,
- You may request the rectification of your personal data if it is incorrect or incomplete,
- Due to your particular situation, you may object to the processing of your personal data if we process it based on our legitimate interest; you may also object to the processing of your data for direct marketing purposes,
- In cases specified by law—e.g., if your data is outdated, unnecessary, processed unlawfully, if you have withdrawn your consent (where consent was the basis for such processing), or if you have effectively objected to the processing of your personal data—you may request the erasure of your personal data,
- You may request the restriction of processing for the period during which we consider your objection or notification regarding the accuracy of your personal data, the lawfulness of the processing, or our legitimate interest, as well as if you need the data to establish, exercise, or defend legal claims,
- In any case where you believe that our processing of personal data violates the provisions of the GDPR, you also have the right to lodge a complaint with the President of the Personal Data Protection Office (PUODO).
DO YOU HAVE TO PROVIDE US WITH YOUR DATA?
Providing your personal data is entirely voluntary, but please remember that refusing to provide it will prevent us from achieving the purposes for which the data is collected—for example, it may prevent or hinder your use of the Site’s functionalities and resources.
SECURITY OF PERSONAL DATA
The Controller takes measures to ensure that your personal data is processed securely and in accordance with GDPR requirements. Among other things, the Controller ensures that access to data is restricted only to authorized persons and only to the extent necessary for their tasks. Furthermore, the Controller takes all necessary steps to ensure that its subcontractors and other entities processing data on its behalf provide an adequate guarantee of data security.
CHANGES TO THIS PRIVACY POLICY
The Privacy Policy may be modified by the Controller, including to reflect changes in law, technological progress, changes in business operations, or new services. Any changes to the privacy policy will be signaled by the Controller by posting relevant information on the Site. In the event of material changes, the Controller also has the right to inform users in other ways (for example, via email).
This privacy policy applies exclusively to our Site and the data processing performed by the Controller. It cannot be extended to data processing by third parties with whom the User connects via a provided link, by entities with whom the Controller cooperates to provide services ordered by the User, or by entities obtaining information about the User through the Site. The Controller bears no responsibility for the further processing of data described above.
